Term & Conditions
1. Shipping Procedure and Delivery Terms
- a) All shipments must be booked exclusively via the Nexus Global Portal, API Integration, or Customer Service team.
- b) The minimum chargeable weight per shipment is 0.5 KG.
- c) Applicable taxes including GST will be charged in accordance with prevailing provincial laws.
- d) If the recipient refuses delivery for any reason, the parcel will be returned to the merchant with a new consignment number, and return charges will apply.
- e) For shipments where the volumetric weight exceeds the actual weight, the following formula applies (dimensions in CM): (Length x Width x Height) / 5000.
- f) COD shipments are uninsured unless the merchant requests and pays for insurance coverage separately.
- g) Packaging Responsibility: Merchants are fully responsible for appropriate packaging based on product nature. Nexus Global shall not be liable for any loss or damage arising from insufficient packaging.
- h) Documents Required for Account Setup:
* Bank account information for payment processing
* Name of the client or registered company
* Official office or pickup location address
* Copy of CNIC of the authorized representative
* Contact person’s full name, job title, phone number, and email address
2. Liability and Limitation of Damages
- a) *Nexus Global shall not be responsible for any shortages reported by the consignee. It is the customer’s duty to verify the accuracy of the packed quantities, as Nexus Global does not inspect shipment contents.
- b) b) The safety and adequacy of packaging remain the client’s obligation; Nexus Global disclaims liability for any damages caused by improper or insufficient packing.
3. Notification of Claims and Legal Action
- a) Claims for damage to shipments will not be accepted; clients must ensure fragile and delicate items are adequately packed.
- b) Claims apply solely to shipments lost during transit within Pakistan caused by theft, robbery, snatching, or accidents. Claims will be rejected if parcel seals show signs of tampering or breakage.
- c) No responsibility is assumed for fragile goods such as glass, plastic, wood, liquids, etc., even if insured.
- d) Nexus Global disclaims liability for shortages reported after delivery when parcels are received in acceptable condition.
- e) The maximum claim amount shall not exceed the declared value of the product. For insured shipments, claims are limited to the insured amount indicated on the consignment note, provided insurance fees have been paid.
- f) Insurance terms must be formally accepted in writing before shipment for coverage to be valid.
- g) Claims for damage to electronics (LCDs, LEDs, etc.) will not be accepted if caused during transit; adequate packaging is the client’s responsibility.
- h) Claims will not be considered for shipments lost due to:
* War, labor strikes, or civil unrest
* Acts of terrorism
* Explosions or related incidents
* Natural calamities such as earthquakes, fires, and similar events
- i) Validated claims will be processed and compensated within 14 business days..
- j) Requests for Proof of Delivery (POD) exceeding 90 days from the date of booking will be considered invalid and will not be processed.
4. Responsibility for Indirect and Consequential Damages
Nexus Global shall not be held responsible for any indirect damages, including but not limited to loss of business, lost profits, or any consequential losses.
5. Terms and Conditions of Transport
- a) Domestic shipments are subject to the provisions of the Carriage by Air Act 1934 (Pakistan).
- b) Shippers must ensure the accuracy of all information and provide necessary documentation for customs, law enforcement, or other regulatory procedures.
- c) Acceptance of delivery by the consignee without raising objections shall be deemed confirmation of receipt in satisfactory condition.
- d) Nexus Global disclaims liability for any loss, delay, or damage unless negligence is established.
- e) The carrier’s liability is limited to Rs. 88.20 per kilogram unless a higher declared value is provided with applicable additional fees.
- f) In cases of delay, liability shall not exceed the lesser amount between actual damages incurred or twice the freight charges.
- g) Hazardous materials may be rejected, abandoned, or disposed of without any liability on the part of the carrier.
6. Client Agreement and Acceptance
By creating an account with Nexus Global, the client confirms acceptance of these terms and agrees to hold Nexus Global harmless from any liability related to loss or damage resulting from its services. Nexus Global’s responsibility is limited to transportation only and does not extend to the contents of the parcels.
7. Supplementary Terms and Conditions
- a) Nexus Global Consignment Note (CN): All consignment notes are non-transferable. The shipper is responsible for ensuring the accuracy of all information. Nexus Global shall not be liable for any incorrect data provided.
- b) No Modifications: No agent, employee, or representative of Nexus Global has authority to modify these Terms & Conditions.
- c) Acceptance Process: Bookings made through the portal or API constitute acknowledgment that Nexus Global assumes no responsibility for inspection of shipment contents, particularly for high-value items.
- d) Right of Retention: Nexus Global reserves the right to hold shipments until all outstanding charges have been settled.
- e) Exclusions of Liability: Nexus Global disclaims responsibility for delays caused by factors beyond its control, including weather conditions, war, government regulations, and similar events.
- f) Claims Submission: All claims must be filed in writing within 7 days of shipment. Claims will not be processed without full payment of all applicable fees.
- g) Insurance: Clients are encouraged to secure their own insurance. Absent insurance, Nexus Global’s liability is limited to Rs. 100 per domestic shipment.
- h) Restricted Items: Nexus Global does not transport liquids, firearms, plants, drugs, explosives, animals, perishables, bearer instruments, obscene materials, industrial carbons, diamonds, IATA restricted goods, or any items prohibited by law.
- i) Payment Terms: All payments should be made via crossed cheque payable to Nexus Global’s registered entity.
- j) GST and Rate Adjustments: GST will be applied as per applicable laws. Annual rate revisions will be mutually agreed upon by both parties.
